All parties will appear in court before Federal Judge B. Lynn Winmill, on August 27th in Boise. The Nez Perce Tribe & Idaho Rivers United filed the joint lawsuit against the United States Forest Service last week. Nez Perce Tribal Executive Committee Vice Chairman Joel Moffett said that members of the tribe are not sitting idly by, and will be in Boise when a decision is reached.
"Our chairman plans on being down their along with our attorneys and we plan to argue the case that we filed which is asking the forest service to do their job," said Moffett.
Specifically the suit requests relief from the Federal District Court to prevent--quote--"irreparable harm from occurring to the rights and interests of the Nez Perce Tribe and the values of the Middle Fork Clearwater-Lochsa Wild and Scenic Corridor." - end quote.
Nez Perce Tribal Executive Committee Chairman, Silas Whitman said that the moving of the load without review or tribal consultation has prompted the recent highway protests, as well as the legal action they're now pursuing.
