Former Nez Perce County Sheriff's lawsuit against state dismissed

LEWISTON, ID - A former Nez Perce County Sheriff's $500,000 lawsuit against the State of Idaho and the Idaho Department of Corrections has been dismissed.

According to court documents, Jimmy Ray Dorion filed the lawsuit in February claiming he was seriously injured while in custody on a felony accessory to burglary conviction.

U.S. District Court Judge Lynn Winmill dismissed the lawsuit, advising Dorion that the 120 day limit for service of summons as to the two defendants had expired. Dorion would have had to file a petition by July 26th, 2012 showing good cause as to why the 120 day period should be extended. However, because Dorion failed to do so, the lawsuit was dismissed.
