Tyrel Smolinski, 21, was indicted by a grand jury on charges of rape, and lewd and lascivious conduct with a minor under 16.
Smolinski previously entered a plea of not guilty, but is now headed to a change of plea hearing. Thursday Judge Kerrick signed an order granting a motion by Smolinski's attorney before moving on with the case.
"What I've done is I've granted the motion for expert witness expenses," said Kerrick. "And so you will need to pursue that and get that evaluation completed from at least your end as quickly as you can."
Both charges carry a maximum of life in prison and up to a $50,000 fine. A change of plea hearing will be held December 19th.
