According to the Nez Perce County Sheriff's Office, a deputy conducted a traffic stop on a 2007 Chevrolet Silverado around 5:00 a.m. on January 23 near Hatwai By-pass and U.S. 95.

The deputy learned the passenger Dillan Smith, had an active warrant and was taken into custody.

During the stop, the deputy also learned the driver, Jessica Brunmeier, was on felony probation through Idaho.

She was taken into custody on a probation arrest warrant.

During the inventory search of the vehicle, a Stroeger 9mm handgun and a small pen were located in a backpack.

"Unbeknownst to him (the pen) was loaded with gun powder," the press release stated.

While the deputy was looking at the pen gun, the projectile went off and shot the deputy in the stomach. The wound was superficial and he returned to duty with only a bruise.

Both suspects are now in the Nez Perce County jail.

Dillian is being held on an Idaho warrant as well as unlawful possession of a firearm charge.

Jessica is being held on agents warrant as well as unlawful possession of a firearm charge.
